Terms of Service
By using earlier.me — whether as an individual sender, a care facility administrator, a resident, or a family member accessing the service via a shared link — you agree to these terms. Please read them.
The service
earlier.me allows you to compose a message — text, audio, or video — and schedule it to be delivered to a recipient on a date you choose. We store the message securely and send it on that date.
earlier.me is also available to care facilities through an organisational plan. Under this plan, facility administrators can create resident profiles, generate family links for family members to send messages, and manage delivery on behalf of residents — without individual payment per message.
Individual accounts and payment
Each message created by an individual (outside of a facility plan) requires a one-time $20 payment to activate delivery. This covers secure long-term storage and guaranteed delivery. There are no subscriptions or recurring charges for individual users.
Payments are processed by Stripe. We do not store your card details.
Care facility plans
Care facilities subscribe to a monthly plan that covers up to a set number of active residents (currently up to 50). Under this plan:
- Residents and family members can create and activate messages at no additional per-message cost
- The facility administrator manages the resident roster and controls access
- Messages created under a facility plan are subject to the same storage, delivery, and content terms as individual messages
- If the facility's subscription lapses, existing scheduled messages will continue to be delivered, but new messages cannot be activated until the subscription is restored
Facility subscription pricing and billing are managed through Stripe. The facility administrator is responsible for maintaining an active subscription.
Family links
Facility administrators may generate signed family links that allow a family member to view a resident's scheduled messages without logging in or creating an account. By using a family link, the family member agrees to these terms. The facility administrator is responsible for ensuring family links are shared appropriately.
Refunds
For individual messages, because messages are immediately stored and scheduled upon activation, we generally do not offer refunds after activation. If you have an issue, email us at hello@earlier.me and we'll do our best to help.
For facility subscriptions, refunds are handled on a case-by-case basis. Contact us within 7 days of a charge if you believe there is an error.
Your content
You retain ownership of the content of your message. By submitting it, you grant us a limited licence to store and transmit it for the purpose of delivering it to your chosen recipient on your chosen date — nothing more.
You are responsible for ensuring your message does not contain content that is illegal, abusive, or harmful. We reserve the right to delete messages that violate this, without refund.
Delivery
We make every reasonable effort to deliver your message on the scheduled date. However, we cannot guarantee delivery if:
- The recipient's email address is invalid or unreachable on the delivery date
- The message is blocked by the recipient's email provider
- There is a technical failure outside our control
In these cases, Trusted Keepers (if you've added any) will also receive the delivery, providing a backup means of ensuring the message reaches the right person.
Trusted Keepers
You may add Trusted Keepers to any message — people who will also receive a copy when it is delivered, and who can forward it on if the primary recipient cannot be reached. By adding someone as a Trusted Keeper, you confirm you have their permission to share their email address with us for this purpose.
Account access
Access to your messages is tied to your email address. You are responsible for maintaining access to that email address. We cannot transfer message ownership between accounts.
Care facility administrators are responsible for the accounts and actions of any staff they grant admin access to.
Resident data and administrator responsibility
Care facility administrators who create resident profiles are responsible for having appropriate authority to do so, and for ensuring the information they enter is accurate. By creating resident profiles, administrators confirm they are acting in accordance with their facility's obligations to residents and applicable privacy laws.
Service availability & continuity
We intend to operate earlier.me indefinitely. Messages are stored across redundant AWS infrastructure with continuous backups and no single point of failure.
In the unlikely event that we need to shut down the service, we commit to:
- Notifying all registered users and facility administrators by email at least 90 days before any shutdown
- Delivering every scheduled message before the service closes — no exceptions
- Providing a full data export of message content upon request
- Making reasonable efforts to transfer the service or its obligations to a trusted successor
Your message will not simply disappear. That's a commitment we take seriously.
Limitation of liability
Earlier.me is provided as-is. To the maximum extent permitted by law, Everyday Studios Group LLC is not liable for any indirect, incidental, or consequential damages arising from use of the service.
Governing law
These terms are governed by the laws of the United States.
